The Hear for the Holidays promotional pricing is only open to legal residents of the United States of America and is void where prohibited by law. The promotional pricing is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. When/as necessary, this promotional pricing may require a valid prescription with appropriate notes detailed by the prescribing physician.
2. Agreement to Rules: By participating in the Hear for the Holidays Campaign promotional pricing, you agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Earlens Corporation as final and binding as it relates to the eligibility and application of the promotional pricing.
3. Campaign Period: The Hear for the Holidays Campaign promotional pricing will be available from October 10, 8:00 am EST, through December 2, 2022, 11:59 pm EST for established patients or those who have completed a Personal Virtual Consultation (PVC). All purchases must be completed AND all ear impressions must be post-marked to Earlens Corporation by December 2, 2022, date.
4. Terms & Conditions: Earlens Corporation reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Hear for the Holidays promotional pricing campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Earlens Corporation’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. Earlens Corporation reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the order entry process or promotion pricing as part of the Hear for the Holidays Campaign or its website or violates these Terms & Conditions. Earlens Corporation has the right, in its sole discretion, to maintain the integrity of the Campaign, to void the promotional pricing for any reason. This promotion cannot be combined with other Earlens Corporation promotional pricing (i.e. webinar promotion, 1st five promotion, or any other promotions or discounts).
5. Limitation of Liability: By entering, You agree to release and hold harmless Earlens Corporation and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Hear for the Holidays Campaign and/or his/her acceptance, use, or misuse of any promotional pricing or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the order entry process for the Campaign; (v) electronic or human error in the administration of the Promotion to include mailing and parcel delays.
6. Disputes: THIS Hear for the Holidays Promotional Pricing Campaign IS GOVERNED BY THE LAWS OF the United States of America AND California, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.

9. By participating in the Hear for the Holidays Promotional Pricing Campaign you have affirmatively reviewed, accepted, and agreed to all the Official Rules.
II. Hear for the Holidays Promotion - Practice Holiday Party Contest
1. Practice Holiday Party Prize: An Earlens-affiliated practice that complete at least ten (10) or more Personal Virtual Consults (PVCs) regarding Earlens products with their established patients during the Hear for the Holidays Campaign period October 10 – December 2, 2022, will receive one $500.00 gift card prize toward a Holiday Party. Actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by Earlens Corporation. No cash or other prize substitution shall be permitted except at Earlens Corporation’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of winning provider practice(s). If the practice uses fraudulent methods or otherwise attempt to circumvent the rules, it may be removed from eligibility at the sole discretion of Earlens Corporation. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by practice winner(s) is permitted. Acceptance of prize constitutes permission for Earlens Corporation to use practice winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.

Practice Prize Qualification aka ‘winner’ and Notification: Practices will qualify for a holiday party gift card if ten (10) or more patients from their practice complete PVCs during the Campaign period. Patients select the practice with which they associate on the holidays.earlen.com landing page. Earlens Corporation will notify by email the winners that qualify) within ten (10) days following the promotional period. Earlens Corporation shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner(s) cannot be contacted, is ineligible, fails to claim the prize within 10 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner(s) of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations.
